Tom Martino, also known as The TroubleShooter and for ReferralList.com, built his reputation as a consumer advocate on the local Denver radio and television stations years ago. After a rise to heights beyond his imagination, his fall from grace comes at a cost of public humiliation and considerable personal loss.

The most recent of Martino’s troubles resulted in an arrest for allegedly assaulting his wife and disturbing the peace. On December 20, 2013, Martino was detained, and released on a $500 bond. Tom Martino was charged in Denver municipal court with domestic violence resulting in criminal charges of:

• Sec. 38-89. Disturbance of the peace.
  (a) Generally. It shall be unlawful for any person to disturb or tend to disturb the peace of others by violent, tumultuous, offensive or obstreperous conduct or by loud or unusual noises or by unseemly, profane, obscene or offensive language calculated to provoke a breach of the peace or for any person to permit any such conduct in any house or upon any premises owned or possessed by such person or under their management or control, when within such person’s power to prevent, so that others in the vicinity are or may be disturbed thereby.
• Sec. 38-93. Assault.
  It shall be unlawful for any person to intentionally or recklessly assault, beat, strike, fight or inflict violence on any other person.

On May 23, 2014, Martino pled guilty to disturbing the peace. The city attorney dismissed the assault charge. Martino received a deferred judgment sentence for one year probation. Martino’s deferred judgment requires domestic violence classes, possible community service and no further violations of any kind.

A deferred judgment sentence is eligible for sealing immediately following the satisfactory completion of probation. “Dismissed” on a court record does not automatically seal the case from public view. An attorney can assist in filing a petition to seal an eligible criminal case.

Tom Martino has a difficult road ahead. The Martino’s are in the process of divorce. He was charged with harassment in Douglas County. The charge was dismissed by the prosecutor. He filed for bankruptcy. If he has any involvement with law enforcement, he will lose his deferred judgment and is subject to up to one year in jail.
