    Computer Crime also is committed when a person intentionally alters, damages, or causes impairment of the proper functioning of the computer including damage to software, documentation or data contained in the computer.

    Identity theft and fraud and common charges associated with computer crime but this is a wide ranging offense that may include embezzlement, pornography, hacking, war games and more.

    If you are being investigated or charged with a computer or internet crime in Colorado you should expect to be served a warrant for search and seizure of all of your computer and electronic devises, software and any information concerning the allegation.   If you are being investigated at work for computer theft or altering of data, your employer may have contacted police.  Make no statements and DO NOT make a confession expecting any leniency from the detectives assigned to this investigation.   

    Upon lawful seizure, police forensic investigators are capable of recovering potentially admissible evidence including deleted material from hard drives and other devises collected during the arrest, search, and seizure.

    As with all criminal allegations it is critical to obtain as much information about the incident as quickly as possible.  There are different strategies to approach defending against various computer theft or fraud charges.  Every person and every case is unique.  I analyze my client’s situation and create an individualized defense strategy to achieve the most favorable disposition in a case which would include negotiating the amount or manner of payment of restitution. 

    My goal is to negotiate the best possible resolution to your case which would include pursuing a Dismissal, Deferred Judgment, or Diversion / Alternative Sentencing Program if available.  Deferred Judgment is accepting a guilty plea and successfully completing probation without violations within the specified time.  Upon completion, the plea is withdrawn and the case is dismissed and is eligible for Sealing which permanently removes the case from public view.

    Sentencing and Consequences
    Computer Crime is almost always combined with other offences.  The sentencing for a computer crime charge ranges from a Class 3 Misdemeanor with up to 6-12 months in jail plus fines and up to a Class 3 Felony with up to 12 years in prison plus fines.  Sentencing conditions may include probation, community corrections or prison.   There is no mandatory sentencing for computer crime.
