On April 4, 2013 Xavier McDaniel, 20, allegedly entered a unlocked apartment and attempted to sexually assault a teen aged girl. He is being held without bail at Jefferson County Detention Center.

McDaniels’ first appearance in court is Monday. Bond amount and terms will be set at that time. McDaniel has been charged with 1st degree burglary and attempted sex assault with serious bodily injury. The Jefferson County District Attorney’s office will file formal charges later in the week.

The teenage victim was able to identify McDaniels’ 1990’s model white Jeep Cherokee as he drove away. Police located his car in the same complex. McDaniel was arrested at work in Douglas County.

Because of the victims age and seriousness of the injuries in the sexual assault, actual charges will not be formally filed in court until later in the week. Prosecutors will consider McDaniel’s criminal history in determining the charges and penalty range for these crimes.
