Sex Offenses on a Child Criminal Charges in Denver

Being accused of sex assault on a child is life changing.  Family, friends and even co-workers are reluctant to offer support that you need during such a devastating accusation.  It is important to stay silent except with your criminal defense attorney.  You have the right to your silence and dignity during this trying time.  You need to contact a sex assault on a child lawyer to represent you and defend your rights as soon as possible.  

The prosecutor will be very aggressive with their investigation and criminal charges.  Law enforcement and governmental agencies will vigorously look for evidence to support the accusations of the victim and their families.  Child services will also be aggressive in protecting the victim.

Arrested for Sex Offenses

An arrest can be made if law enforcement believes there is probable cause.  A prosecutor will try to bully you into pleading guilty.  Don’t talk to anyone until you’ve hired an attorney.  Don’t incriminate yourself.   An investigation by police, child services and the prosecution will give a qualified, experienced criminal defense attorney in sex offenses the information needed to build a proper defense.  

A temporary restraining order will be filed against you.  You will not be allowed to contact the victim and your children under the age of 18.  It is possible the child or children may be removed from your home and placed with family members or protective services during the case.

All of the above convictions require registration on the sex offender registry.   The registry requires registering annually on your birthday and for more serious crimes, registering quarterly.  Deregistration can be obtained after a specific period of time depending on the sex offense.  You can try deregistration once a year.  It is a difficult process and an attorney that specializes in deregistration is recommended.  

Building a Defense

Since any sex offense of a child is an extremely life changing event with severe consequences a skilled criminal defense lawyer in Denver metro area is essential.  This lawyer should have years of experience and knowledge of sex assault cases to build a solid defense for you.  Perhaps you have been wrongly accused by the victim.  Or maybe you have child pornography on your devices that you don’t know how it got there.  Many attorneys don’t want to take such cases because they are so sensitive in nature.  There is always a defense and the sooner you hire a lawyer the better.  Stop talking except to your lawyer.

How to negotiate with the District Attorney

The prosecutor is eager to work on sex assault cases.  They will intimidate you into taking their first offer and that offer is never going to be a reasonable offer.  These cases are serious and a conviction is devastating to you, your family and friends.  The goal is to gain the best resolution possible in your case.

If your case goes to trial the prosecutor most prove beyond a reasonable doubt that you have committed a crime.   The challenge is to disprove the evidence they have against you.   Has the victim been honest in their allegations?  What does law enforcement have as evidence of you committing a crime?  Is there a real victim or is it sting operation with no victim?  All good questions in your case.  

I will use an investigator to look at your mitigating circumstances.  I will review police records and whatever the district attorney has as evidence.   It is important to tell your attorney everything and be as candid as possible.  This will be the biggest battle of your life and you need an experienced, knowledgeable and qualified criminal defense lawyer to fight for your rights and innocence.

Putting your rights and interests first

Your rights as a citizen are in jeopardy with a sex offense allegation.  If convicted of a felony sex offense you will lose you right to own, possess or use a firearm.  You will have to register as a sex offender.  You may have to serve some jail or prison time.  You may lose you right to live with your family and in your own home.  My goal as your defense attorney is to put you rights first.  Every effort will be to minimize the damages and get you back to work and with the ones your love as soon as is possible.
