Marijuana Possession

Cited for Possession of Marijuana in Colorado?

Myth: Denver passed a law decriminalizing possession of small amounts of marijuana. I cannot get arrested or fined if I am carrying a little bit of pot.

Reality: Although Denver did pass such a law, Denver city prosecutors have the power to enforce state law. Under Colorado state law, possession of small amounts of marijuana is still a crime. You CAN be arrested. This law is being enforced more often than ever.

Myth: I just have to pay a fine if I am cited for possession of marijuana. There are no other negative consequences.

Reality: Even though you get "cited and released" with a $100 fine, that drug conviction still goes on your criminal record, which follows you throughout your life. With a drug possession conviction on your criminal record, you may be denied federal student aid for college or have a hard time getting a job.
