Search and Seizure Issues

There are constitutional rights that may become an issue if you have been subjected to an illegal property search. Was your search based on probable cause? Was the search warrant executed properly? Were there exigent circumstances that warranted a search and were they apparent? I can help you determine the answers to these questions, and if the answer to any of them was no, how to attempt to successfully challenge the evidence in question.

Most illegal searches occur in a residence or a vehicle. Vehicle searches are often deemed to be valid, but the United States Supreme Court, in Gant v. Arizona, has altered the standard of what a police officer may search in a vehicle incident to an arrest, and many police departments have not yet adjusted their procedures to comply with this ruling.

Additionally, your expectation of privacy is based on a sliding scale that is determined by circumstance. For instance, you are most protected while in your own residence, but when you are being screened at the airport, your privacy is secondary to the security of everyone else.
