Deregistration

Colorado Criminal Defense Attorney Assisting with Sex Offender Deregistration

Registering as a sex offender is often a humiliating experience that can follow someone for the rest of their lives, even after they have "paid their debt to society." However, it is possible to have your name removed in certain circumstances, but you must petition the court for deregistration and be extremely careful in how you present your request.

This is why it is crucial that you consult with a knowledgeable criminal defense lawyer who is familiar with the steps involved when applying for deregistration. Philip M. Smith has over 30 years of legal experience, and he can guide you through the process of deregistration as well as evaluate if you qualify for this kind of petition. Depending on the charge that you have been convicted for, you may be required to stay on a sex offender registry for anywhere from five years to the rest of your life. I can advise you about your chances of a successful deregistration petition and help you with the process for any criminal charge relating to a sex offense including:

If you do decide to apply for sex offender deregistration, you must give notice to the court of your intent to file a deregistration petition. This will give the judge, prosecutor, and victim in your case a chance to protest the petition. This intent to file must also be given to every jurisdiction where you were required to register, which may include multiple states.

It is a good idea to have the support of your parole officer, counselor, and anyone else that may be linked to the conditions of your parole, such as a treatment provider who can attest that you are no longer a threat to society and that the deregistration petition has merit. If you are employed, a statement by your employer stating your conduct and continuing employment will also provide additional support.

There are significant penalties associated for failing to properly register or failure to follow the deregistration process correctly. Even if you are just moving to another state, you must give notice to both states of your intentions to satisfy the requirements of a potential move.

If you are considering de-registration, I can help. Call me at my Colorado criminal defense law firm for a free initial consultation with an experienced defense lawyer.
